At the UC Berkeley/Penn Energy Law Scholars Workshop in Philadephia, PA, on June 5, 2024, I presented my working paper on offtake and transportation agreements for Carbon Capture Projects in the US. A short article on the topic was then published in the Kleinman Center for Energy Policy Insights Newsletter on July 17, 2024.

The paper examines how offtake and transportation agreements provide a transactional framework for outlining the respective roles and obligations of project developers, equity investors, and other interested parties in an ideal CCUS project. The discussion highlights the project risks and reviews the evolving U.S. policy measures and incentives driving commercial interests and investment decisions regarding such CCUS project risks. The contractual tools are essential for scaling up CCUS applications as needed to meaningfully contribute towards decarbonization objectives in developed and industrialized economies on the part to net zero. These agreements and commercial structures provide an avenue for securing firm commitments from project participants, while also addressing feasibility issues.
